Zu früh geschossen: Standard & Poor’s Financial Services LLC verliert UDRP-Verfahren um boycottstandardandpoors.com

Die international bekannte Kredit-Ratingagentur Standard & Poor’s scheiterte mit dem Versuch, den Domainnamen „boycottstandardandpoors.com“ in einem Verfahren nach der Uniform Domain Name Dispute Resolution Policy (UDRP) übertragen zu bekommen (Standard & Poor’s Financial Services LLC v. Christian Mendes, WIPO Case No. D2013-1546).

Die Entscheidung ist aus meiner Sicht bemerkenswert, da der Domainname bislang ungenutzt war und der Domaininhaber sich lediglich darauf berufen hat, seine Rechte nach dem Ersten Zusatz zur US-amerikanischen Verfassung auszuüben und den Domainnamen nicht in Verbindung mit rechtsverletzenden Angeboten nutzen zu wollen. Damit stand eine zulässige Nutzung des Domainnamens nach § 4(c)(iii) der UDRP im Raum („you are making a legitimate noncommercial or fair use of the domain name, without intent for commercial gain to misleadingly divert consumers or to tarnish the trademark or service mark at issue.“). Allerdings privilegiert diese Regelung nach Ihrem Wortlaut im Gegensatz zu § 4(c)(i) der UDRP nicht Vorbereitungshandlungen oder die theoretische Möglichkeit einer entsprechenden Benutzung sondern eigentlich nur eine bereits erfolgte Nutzung. In § 4(c)(i) der UDRP steht im Gegensatz dazu: „before any notice to you of the dispute, your use of, or demonstrable preparations to use, the domain name or a name corresponding to the domain name in connection with a bona fide offering of goods or services“.

Das Schiedsgericht ging gleichwohl davon aus, dass eine zulässige Nutzung nicht ausgeschlossen und die Beschwerde zu früh eingereicht worden sei. Der Beschwerdeführer solle die konkrete Nutzung des Domainnamens abwarten. Wörtlich heißt es in der Entscheidung:

B. Rights or Legitimate Interests

As Respondent conceivably could use the domain name at issue in a manner that would not constitute bad faith registration and use, and as the domain name at issue has yet to be used to resolve to a web site, Complainant has failed to establish that Respondent has no rights or legitimate interests in respect of the domain name at issue.

C. Registered and Used in Bad Faith

Respondent is not currently using the domain name to resolve to a web site. Since it is conceivable that Respondent could use the domain name in such a way that Respondent did not seek to profit from the good will attached to Complainant’s family of marks, the complaint has been brought prematurely. Should Respondent in the future seek to profit from the good will attached to Complainant’s family of marks, Complainant may file a complaint at such time. Accordingly, the Panel finds that at present, Complainant has failed to establish bad faith registration and use as required under the Policy.
